Enforcing a judgment from Edmonton County Court and Family Court
Winning at Edmonton County Court and Family Court gets you a County Court judgment (CCJ) - not your money. If the losing party does not pay within the period the judgment allows (usually 14 days), you must enforce, and the route depends on what they own and earn. Choosing an enforcement route
A warrant of control sends bailiffs to collect - cheapest if the debtor has goods; request it on Form N323 with a fee added to the debt. If they are employed, an attachment of earnings order (Form N337) takes payments from wages via their employer. If a third party owes them money (a bank account, a customer), a third-party debt order intercepts it. The court can also order the debtor to attend for questioning (Form EX140 is used in the means process) to find out what they have.
Timing and limits
Enforcement has time limits - a warrant generally must be requested within 6 years of the judgment, and interest under s.69 stops accruing once you issue enforcement. Match the method to the debtor: wage earners suit attachment of earnings; tenants with goods suit warrants; businesses with receivables suit third-party orders.
